Privacy on fabria.pl
This is an English translation. If the two versions differ, the Polish version prevails.
Who is responsible for your data
The data controller is Emanuel Maciołek, a sole trader operating as Emanuel Maciołek Fabria, ul. Józefa Sawy-Calińskiego 102A, 31-999 Kraków, Poland, tax ID (NIP) 6782631030 ("Fabria"). For anything related to your data, write to kontakt@fabria.pl.
The same rules apply to fabos.pro, which runs on the same server and uses the same contact form. Emails sent directly to kontakt@fabos.pro are handled by the same OVH mail service and kept in the same way as emails to kontakt@fabria.pl, but they are not copied to the Gmail mailbox.
What happens when you browse the site
The site does not use cookies, or scripts, fonts or maps from external services, and stores nothing on your device, so browsing it does not send your data to other companies.
The server records three things:
- Access log: for each visit it records a shortened IP address (without its last part, so it points to a group of addresses rather than one device), the time, the address of the page and of the page you came from, both without parameters after the question mark, and the browser and operating system name. The full IP address never enters this log. Once a week we calculate statistics from it as totals: how many visits there were, which pages are read, where visitors come from and from which countries. We do not track individuals or build profiles. The log also helps protect the site against attacks.
- Error log: when something goes wrong on the server, it records the IP address, the time and a description of the error. It is used only to fix faults and protect against attacks.
- File download counter: it counts how many times a file was downloaded, for example the price list for the Allegro calculator. It does not record the IP address or browser information, so it contains no personal data.
The tools in the Tools section run on your computer and do not send us what you type into them. The Allegro calculator fetches only the price list file from fabria.pl. The interest calculator and the NBP rates tool connect to the server of the National Bank of Poland, which is responsible for those connections itself.
When you write to us
When you send a message through the form, we record your name, email address, the message and the time it was sent. Emails sent directly to kontakt@fabria.pl are kept in the same way as messages from the form. To protect the form against spam, we also keep a hash of your IP address for 24 hours: an encoded form made with a secret key that changes every day, from which the address cannot be read without that key.
Giving your name and email address is voluntary, but without them we cannot reply.
Why and on what legal basis
| What | Why | Legal basis |
|---|---|---|
| Access log | visitor statistics as totals and security of the site | our legitimate interest (Art. 6(1)(f) GDPR) |
| Error log | operation and security of the site | our legitimate interest (Art. 6(1)(f) GDPR) |
| Form and email | replying to your enquiry; when you ask about working together or an offer, also taking steps before entering into a contract | Art. 6(1)(b) GDPR (matters before a contract), otherwise Art. 6(1)(f) GDPR (replying to messages) |
| IP address hash | protecting the form against spam | Art. 6(1)(f) GDPR |
How long we keep it
- Access log: 30 days, after which entries are deleted automatically. Statistics as totals, without IP addresses or individual visits, are kept longer so we can compare months.
- Error log: 14 days, after which entries are deleted automatically.
- IP address hash from the form: 24 hours.
- Messages from the form and emails: 12 months from sending. If the conversation leads to a contract, the documents needed to settle it are kept for as long as tax law requires.
- Backups: the form database is copied every night to an OVH server and to a Fabria server in Poland. Deleted data disappears from the database immediately, and from backups after about 3 months at the latest, when the backups are overwritten.
Who we share it with
We do not sell data. The site, the form and the kontakt@fabria.pl mailbox are hosted by OVH, which stores the data on our behalf under a data processing agreement (Art. 28 GDPR). The server and the mailbox are in the European Economic Area.
Copies of emails sent to kontakt@fabria.pl also go to a Gmail mailbox that Fabria runs with Google (Google Ireland Limited, Ireland). Google processes them under its own privacy policy (policies.google.com/privacy), and the data may be transferred to the USA in the process. We delete the copies on the same schedule as the originals (12 months).
We do not make automated decisions or build profiles based on your data.
Messages are also read by the AI assistant Claude, which helps sort them and draft a reply. A human approves every reply before it is sent. The provider is Anthropic (in Europe: Anthropic Ireland, Limited), which processes this data as a separate controller under its own privacy policy (anthropic.com/legal/privacy). The data may be transferred to the USA in the process. Anthropic transfers it on the basis of a European Commission adequacy decision (Art. 45 GDPR), standard contractual clauses (Art. 46 GDPR) and, in some situations, the derogations provided for in the GDPR (Art. 49).
Your rights
You can request access to your data, its rectification, erasure or restriction of processing. You can also object to processing based on our legitimate interest. If the basis is a contract, talks before a contract or your consent, you can also receive your data in a portable format. You can withdraw consent to messages at any time, without affecting messages sent earlier. Write to kontakt@fabria.pl. For the access log or the error log, give the date and time of your visit and your browser name. In the access log the IP address is shortened, so we may be unable to tell which entries relate to you. If so, we will tell you.
You have the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw, Poland, uodo.gov.pl).
